TX Lawmaker Proposes Bill Allowing Minors Who Were Taken to Drag Shows to Sue Performers Up to 10 Years Later

Texas House Republican Representative Steve Toth introduced HB 4378 on Thursday. The bill would allow “an individual who attends a drag performance as a minor” to “being an action against a person who knowingly promotes, conducts, or participates as a performer in the drag performance that occurs before an audience that includes the minor…”

According to the bill, if the court finds in favor of the plantiff, they could win $5,000 in fees and damages.

If passed, the bill would allow for a civil suit to be brought against performers up to a full decade after the incident.

Opponents have pointed out that the stipulations of the bill use bounty hunting tactics aimed at the trans community. For example, would trans music artists still be able to perform legally in Texas in a non-drag show setting?

At least 18 states are considering, or have passed, bills restricting drag performances. This bill sets another dangerous precedent and further criminalizes drag performers and the art form.
