Biden Administration Sides With Norfolk Southern in Supreme Court Case
Norfolk Southern, the company responsible for a massive train derailment earlier this month that released an irreparable amount of hazardous materials into the air and soil in Ohio, has asked the Supreme Court to throw out a 2017 lawsuit from a former rail worker that claims exposure to toxic chemicals caused his colon cancer.
Robert Mallory was exposed to asbestos and other toxins while working for Norfolk Southern. In a lawsuit filed in Pennsylvania, he claims that exposure led to him developing colon cancer in 2016.
Mallory alleges that Norfolk Southern failed to provide him with safety equipment and the resources necessary to stay safe while exposed to hazardous substances.
Mallory’s lawsuit was appealed at the state and federal levels, eventually making it to the Supreme Court.
In response to the lawsuit reaching the Supreme Court, Biden’s Department of Justice has filed a brief backing the rail giant.
The DOJ’s support of Norfolk Southern is in stark contrast to the the Biden administration’s public statements regarding the Ohio derailment. White House Press Secretary Karine Jean-Pierre stated in a briefing after the disaster, “The health and safety of the community is our top priority.”
Jean-Pierre continued, “We understand the residents are concerned as they should be ... and we're going to try to figure out an answer.” Adding, “We're going to hold Norfolk Southern accountable."
