Daniel Penny, Man Who Put Jordan Neely in Fatal Chokehold, Expected to Surrender and Face Second-Degree Manslaughter Charge

Daniel Penny, the man who put Black subway busker Jodan Neely in a several minute long fatal chokehold, isn’t in custody yet. However, he is expected to turn himself in on Friday.

According to the Manhattan DA, Penny will be charged with second-degree Manslaughter.

On May 1st, Penny put Neely in chokehold after alleging he was being aggressive while pleading for food from F Train riders. Penny, who is a former Marine with military training, was questioned immediately following Neely’s death but was released. A video taken by another rider was made public after the incident, sparking outrage.

Since his death, there have been protests in New York and around the country demanding justice for Neely. Neely was homeless and suffering from mental illness at the time of the incident.
